  1. Was recently injured at work, As of April 12th was injured, seeked medical attention on April 14th. I was instructed by my Dr. they put me on Light duties, my employer claimed there was NO Light duties for me. I remained on off til next appointment. Even though I was really not up to Par to return, I didn’t have much leave left to use either. So convinced Dr. for me to return with no restrictions so I can return back to work. I returned the day after seeing the DR. and was written up for 2 no call no shows, as I texted the Director late on both dates. I felt I was being Bullied at this point by My Director as well has the HR personal that happen to be there as well. As they brought up these write ups, The HR person was smuckering. I brought up the facts that Yes I did notify you, still did not hold. So I signed as I wanted to move on through my first day back to work. I asked my director for a copy of the Policies and Positedurs and she did not have one, she said go ask HR. I then fallowed hr to her office and she said she would email them to me, received nothing. This all happen on a Friday. I returned on Monday and seeked down a copy of the P&P, and seeked out an area that stated some info on grievance. So on Tuesday I went to the other HR personal she stated I had until Wed. to file grievance, I emailed Director that night Tuesday evening, printed off and handed over a paper copy to my director as well as HR. this was dated May 3rd, as on May 4th, Director insisted on doing an evaluation and the descriptions’ on this might be my name but not any to none of my work ethics, I feel she used the grievance and my absences against me to the upmost, and feeling of harassment has taken place. I felt I have had to walk on egg shells; I feel that these working conditions are unprofessional. So we did have a day off making a long weekend. As I returned back on that Tuesday, went on an all day field trip, when I returned I received a letter regarding the grievance I did and stated I had no grounds. Wednesday My head hurt, chest hurt, stomach and back all hurt, Needed to stay home a try and regain myself from yesterday’s long day trip and activities’ text in before my shift and basically stated that this is a reorrcurance, MY Last one, I did not reply, Gave my notice instead.
    Do I have any legal rights for L&I or anything here? We teach the kids NO BULLING, NO HARASSING, yet this happens.     YES I can my write ups (2), and P&P and My grievance letter along with theirs, as well as my Evaluation..

    • You might need to talk to an attorney well versed in employment law to determine whether you have any recourse against your employer for the grievances you’ve described. As for the L&I claim, if you are limited to light duty, and none is available, you should be receiving time-loss benefits. You do not have to use your sick leave or vacation days.
      I would suggest you continue to follow up with your medical provider to outline a treatment plan for your injury. If you are still off work and not receiving any benefits, you should talk to a workers comp attorney and get some help with your claim.
